释义 | 搜查令 A document issued by a person with authority given by the law to issue it (IRC v Rossminster Ltd [1980] AC 952, 1 All ER 80 (HL)) which authorises the invasion of premises without the consent of the persons in lawful possession of them and the search and, in almost all cases, seizure of things answering the description given in the warrant. Generally, acts done to obstruct those authorised to execute a search warrant are rendered criminal. For example, where the person conducting the search is a police officer, the person obstructing him may be guilty of obstructing or resisting a police officer in the execution of his duty under the Offences Against the Person Ordinance (Cap 212) s 36(b). The validity of a search warrant depends on it being issued in conformity with the statute which authorises its issue: Re A Company and the Independent Commission Against Corruption (HCMP 544/96, unreported).
