| 释义 | 超速駕駛 1. Driving a vehicle at a rate exceeding the prescribed legal maximum. It is an offence to drive a vehicle on a road at a speed exceeding the prescribed speed limit: Road Traffic Ordinance (Cap 374) s 41(1). However, the provisions of any enactment imposing a speed limit on motor vehicles shall not apply to any vehicle on an occasion when it is being used for fire services, ambulance, customs and excise service or police purposes, if compliance with those provisions would be likely to hinder the use of the vehicle on that occasion for any of those purposes: s 77 (1). A trial court may determine the speed of a travelling vehicle without need to hear expert evidence: R v Cheung Shing Wai [1993] 1 HKCLR 311; HKSAR v Au Chi Wai Alan [2000] 2 HKC 31. 2. In tort, the speed at which a vehicle is driven is material to the question of liability: Lau Shun Hing v Ng Ching Hung [1991] 1 HKC 179 (CA). Whether a certain speed will be considered dangerous varies with the nature, conditions and use of the particular highway and the amount of traffic which actually is, or may be expected to be, on it. The duty of a driver to usually drive at a speed that will permit him to stop well within the distance he can see is clear (Kowloon Motor Bus Co (1933) Ltd v Yick Kwok Keung [1991] 2 HKC 632), although it is not conclusive evidence of negligence to exceed that speed (Morris v Luton Corp [1946] KB 114, 1 All ER 1 (CA)).
