The lien extends over the purchaser’s deposit, the proceeds of sales, and over property held by the auctioneer on behalf of the seller: Robinson v Rutter (1855) 4 E & B 954. A lien may be extinguished by waiver: Scarfe v Morgan (1838) 4 M & W 270, for example, by giving up the possession of goods, documents, or money without recovering or retaining the amount owing to the auctioneer: Dennant v Skinner & Anor [1948] 2 KB 164; Halsbury’s Laws of Hong Kong, Vol 1, Auction [30.024].
