| 释义 | 和平集會的自由 The right of people to gather together for any purposes and behaving in a peaceable manner. But the right is subject to the government’s right to impose reasonable restrictions which are necessary in the interests of national security or public safety, the protection of the rights and freedoms: Bill of Rights (Cap 383) s 8 art 17; R v To Kwan Hang & Anor [1994] 2 HKC 293 (CA). Police performing their duty to preserve the public peace and preventing injury to life and property deem keeping an assembly peaceful, so no restriction is imposed on the right of peaceful assembly: R v To Kwan Hang & Anor, supra.
