释义 | 和平集會的自由 The right of people to gather together for any purposes and behaving in a peaceable manner. But the right is subject to the government’s right to impose reasonable restrictions which are necessary in the interests of national security or public safety, the protection of the rights and freedoms: Bill of Rights (Cap 383) s 8 art 17; R v To Kwan Hang & Anor [1994] 2 HKC 293 (CA). Police performing their duty to preserve the public peace and preventing injury to life and property deem keeping an assembly peaceful, so no restriction is imposed on the right of peaceful assembly: R v To Kwan Hang & Anor, supra. See also Freedom of Association. 人有權就任何目的聚集在一起並以和平的方式行事的權利。但此等權利須受制於政府可施加合理限制的權利(即政府為維護國家安全或公共安寧或保障他人權利自由而訂明的合理限制):《香港人權法案條例》(第383章)第8條第十七條;R v To Kwan Hang [1994] 2 HKC 293(上訴法庭)。警隊在執行任務以維持公安及防止損害生命及損毀財產時,當作為維持集會自由,因此對和平集會的權利沒有施行任何限制:R v To Kwan Hang, 見上文。另見 Freedom of Association。 |
