| 释义 | 船代理人 A person who is not a part owner but exercises the functions of a managing owner. From the days before the corporate ownership of vessels became the norm, owners were required to register a managing owner or ‘ship’s husband’ who was personally liable for the performance of the owner’s statutory duties: The Chevron North America (HL) [2002] 1 Lloyd’s Rep 77. A ship’s husband was appointed by shipowners to look after a ship while in port, making sure that she was seaworthy: for example, The Phaliron [1923] 16 Ll L Rep 264. It also operated in a similar fashion to the holder of a power of attorney, and was responsible for outfitting, maintenance, chartering, insurance, collection of funds relating to ordinary course of business: The Rangiora [2000] 1 Lloyd’s Rep 36. A ship’s husband cannot delegate his authority without sanction of owners, or pledge their credit unnecessarily: Doeg v Trist (1897) 2 Com Cas 153. The functions of a ship’s husband are nowadays performed by a ship manager company or a marine superintendent.
