释义 | 無精神行為能力 A state of mind that affects the ability of a person to understand the nature and effect of a given situation. Mental disorder or mental handicap and inability to understand and to make a decision by reason of his mental disorder or mental handicap; or inability to communicate, to any other person who has made a reasonable effort to understand him, any intention or wish to grant a power of attorney: for example, Powers of Attorney Ordinance (Cap 31) s 1A(1). Where necessaries are sold and delivered to a person who by reason of mental incapacity is incompetent to contract, he must pay a reasonable price for them: Sale of Goods Ordinance (Cap 26) s 4(1). 一種精神狀,它影響某人對某特定情況的性質及影響的理解能力。精神紊亂或弱智,並因精神紊亂或弱智而沒有能力明白及作出決定;或無能力把自己的意向或意願傳達予任何已作出合理努力以期明白他的其他人:《授權書條例 》(第31章)第1A(1)條。凡因心智上無行為能力而無訂立合約能力的人獲售賣和交付必需品,他須就該等必需品繳付合理的貨價:《貨品售賣條例》(第26章)第4(1)條。 |
