释义 | 分期執行的監禁刑期 A sentence (ie a term of imprisonment) which is served at the expiry of another sentence. The magistrate has the power to order the term of imprisonment shall commence at any time during or at the expiration of any other term of imprisonment which has been imposed by the Court previously: Magistrates Ordinance (Cap 227) s 57. Similarly power exists in the District Court and the High Court: District Court Ordinance (Cap 336) s 52(1); Criminal Procedure Ordinance (Cap 221) s 68. Sentences for each charge of offence should be consecutive if the offences are separate and distinct: R v Prime [1983] 5 Cr App R (S) 127 (CA); Lui Shu Tong v R [1961] HKLR 129. The fundamental principle is that the sentence passed should reflect the total criminality of the offender. This principle is called the totality principle: A-G v Cheung Shu Loi (CAAR 17/1987, unreported); A-G v Lee Ching Kwong [1987] 2 HKC 563.
