A conscientious objection calls for the existence of a present compulsive and complete conscientious aversion to the particular service. At common law, persons who had conscientious objections to taking an oath were incompetent as witnesses, but they were made competent witnesses by provisions enacted in the Oaths and Declarations Ordinance (Cap 11) are competent witnesses. In any legal proceedings, the burden of proof of conscientious objection rests on the person claiming to rely on it: Offences Against the Person Ordinance (Cap 212) s 47A(6).
