Administrative law - The principle that a decision-maker has no power to delegate a discretionary power to another decision-maker unless there is an express power to do so. There is a strong presumption against construing a grant of legislative, judicial, or disciplinary power as impliedly authorising sub-delegation: Halsbury’s Laws of Hong Kong, Vol 1, Administration Law [10.030]. In accordance with the maxim, a statutory power must be exercised only by the body or officer on whom it has been conferred: Khan v A-G [1986] HKLR 972 (CA); Lau Hon Cheong v A-G [1987] 3 HKC 1 (CA); unless sub-delegation of the power is authorised by express words or necessary implication: Interpretation and General Clauses Ordinance (Cap 1) s 63; A-G v Chiu Tat Cheong & Chiu Te Ken [1992] 2 HKLR 84 (CA). However, consideration of practical convenience may justify entrusting powers to a committee or officers to conduct an investigation and to make recommendations as to the decision to be taken: Halsbury’s Laws of Hong Kong, Vol 1, Administration Law [10.030]. Agency - An agent cannot delegate authority. A maxim which provides that delegation by an agent, that is, the entrusting to another person by an agent of the exercise of a power or duty entrusted to the agent by the principal, is in general prohibited without the express authority of the principal or authority derived from statute: Corlett v Gordon (1813) 3 Camp 472; Sims v Brittain (1832) 4 B & Ad 375, 110 ER 496. However, this maxim does not apply to cases where the delegate task is a ministerial one: Allam & Co Ltd v Europa Poster Services Ltd [1968] 1 All ER 826, 1 WLR 638. See also Agency; Delegation.
Constitutional law - A presumption precluding a person to whom statutory power has been delegated from further delegating that power in the absence of express or implied authority to do so. However, that does not prevent a delegate from exercising a power of attorney if the person is doing no more than a ministerial act: Pang Hin Lam v Lau Wah Kwan [1999] 2 HKC 771 (CA).
