释义 | 積極性的責任 In the law of contract, a term referring to the requirement to perform a contractual obligation. A positive duty usually requires the doing of an act, rather than mere inactivity; it is thus to be contrasted with a negative duty. Where a judgment or order is made requiring an act to be done within a specified time, the court has the power to order the act to be done another time: The Rules of the High Court (Cap 4A) O 45 r 6. Where a party fails to comply the judgment or order requiring an act to be done, the court may order that the act be carried out by a third party at the expense of the disobedient party: O 45 r 8.
