释义 | 不完整的贈與 A gift or bequest where the intention to give is unclear or ambiguous or the formalities required to give effect to the intention have not been properly executed so that the intended gift fails. For example, where the chattel given was not physically delivered to the donee or where the legal transfer was not properly executed. Equity will not construe an imperfect gift as a declaration of trust: Richards v Delbridge (1874) LR 18 Eq 11. The court will not compel the intending donor to complete and perfect an imperfect gift: Wycherley v Wycherley (1763) 2 Eden 175. Such gift can be revoked at any time: Standing v Bowring (1885) 31 Ch D 282 (CA). The ordinary rule is that the law will enforce an executory promise given for consideration, but not an imperfect gift: Milroy v Lord (1862) 4 De G F & J 264.
