| 释义 | 損失賠償估量 Assessment of the amount necessary to compensate a plaintiff for the loss suffered as a result of the defendant’s wrong. In contract, the measure of damages is the sum that will place the injured party in the same position as if the contract had been performed, the general rule being ‘restitutio in integrum’ meaning, so far as money can do: Robinson v Harman (1848) 1 Ex 850, 154 ER 363. The purpose of awarding damages is to compensate the plaintiff for its loss and not to punish the defendant who is in breach: Dawson Enterprises Ltd v Talisteam Ltd [1994] 2 HKC 327. In tort, the measure of damages is the amount necessary to put the plaintiff in the same position as if the tort had not been committed. Also known as ‘assessment of damages’ or ‘quantum of damages’.
