| 释义 | McKenzie友人 A person, whether a lawyer or not, attending the trial as a friend of either party, taking notes and quietly making suggestions and offering advice: McKenzie v McKenzie [1971] P 33, [1970] 3 All ER 1034, 3 WLR 472 (CA). The court retains a discretion, in the exercise of its inherent jurisdiction, to permit a litigant in person to be assisted by a ‘McKenzie’ friend. There are cases where the court has on rare occasions permitted the friend to take an even more active part in the proceedings: Berry, Susan Caroline v William Allan (CACV 170/96, unreported). As to the role of the McKenzie friend, the litigant in person is allowed to have sitting with him someone (a ‘McKenzie’ friend) who can give him advice and help him with the presentation of his case; but it is still the litigant in person who has to present the case to the court: Lobo, Helena George v Bhagwandas K Kripalani [1998] 2 HKLRD 325 (CA).
