释义 | 租賃 In the context of a landlord and a tenant, a right to occupy the land of another, usually (though not only) for a term of years. It includes a tenancy entered into orally or in writing and includes an agreement for a tenancy, and a sub-tenancy: Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 115(1). Subject to exceptions, a tenancy arises when exclusive possession of premises are given for a term at a rent, irrespective of the name given to the agreement: Street v Mountford [1985] AC 809, 2 All ER 289 (HL). A tenancy is to be distinguished from a licence to occupy premises. A tenancy at sufferance, which is not based on consensus and creates no interest in land, is not truly a tenancy: Kung Wong Sau Hin v Sze To Chun Keung [1996] 3 HKC 292 (CA). An agreement for a tenancy is a tenancy for purposes of the provisions governing new tenancies of domestic premises.
