释义 | 忠實責任 The duty of an employee to carry out employment duties with good faith. This duty is implied into all employment contracts. This general duty precludes, amongst other things, the employee from making secret profits; violating the duty of disclosure; competing with employer; soliciting employers customers; misusing of confidential information: Halsbury’s Laws of Hong Kong, Vol 10(2), Employment Law [145.040]. If the employee breaches this duty, he is liable to compensate his employer by way of damages: Kishimoto Sangyo Co Ltd & Anor v OBA & Ors [1996] 2 HKC 260 (CA).
