释义 | 住宅房屋 A building or part of a building in which people actually live or which is physically capable of being used for human habitation: Lewin v End [1906] AC 299. A house may be so even if a large part of it is for the time being used for non-residential purpose: Lewin v Newnes Ltd (1904) 90 LT 160. However, business premises are not regards as dwelling house by reason of their being used for having meals there or sleeping: Lewin v End, supra. It also includes a house which is consisted or adapted for dwelling, although it may at the material time be vacant or not fit for human habitation: Bewerly [1991] 4 All ER 50, Ch 441, 3 WLR 229. 實際上有人居住在其中、或實質上適合人居住的建築物或建築物的部分:Lewin v End [1906] AC 299。即使房屋的大部分在當其時用作非住宅用途,但仍可屬於住宅房屋:Lewin v Newnes Ltd (1904) 90 LT 160。但鑒於商用處所被用作用膳或睡覺的地方,商用處所不被視為住宅房屋:Lewin v End, 見上文。儘管住宅房屋可在關鍵時間是空置的或不適合人居住的,住宅房屋亦包括用作或改裝為住宅用途的房屋,:Bewerly [1991] 4 All ER 50, Ch 441, 3 WLR 229。 |
