| 释义 | 船隻殘骸 1. Property which has been cast ashore with the ebb and flow of the tide after shipwreck. In order to constitute a legal wreck, the goods must come to land; if they continue at sea, the law distinguishes them from jetsam, flotsam, and lagan: R v Two Casks of Tallow (1837) 3 Hag Adm 294. If the article be floating; it belongs to the sea; it is flotsam but not wreck; if it becomes fixed to the land, though there may be some tide remaining round it, it may be considered as wreck, but it having merely touched the ground, and being again floating about, its character will depend upon its state at the time it was seized and secured into possession; whether, for instance, the person who seized it, as salvor, was in a boat, or wading, or swimming: R. v Two Casks of Tallow (1837) 3 Hagg 294, 166 ER 414. In relation to aircraft, the provisions of any law of Hong Kong for the time being in force which relate to wreck may apply in relation to aircraft as those provisions apply in relation to vessels: Civil Aviation Ordinance (Cap 448) s 9(2). 2. In marine insurance, whatever may remain of property that has been severely damaged in a maritime adventure. An underwriter who has paid a total loss on the property is entitled to take over the wreck, dispose of it as thought fit and retain the whole of the proceeds, if any, even if these exceed the claim paid: Marine Insurance Ordinance (Cap 329) s 79(1).
