| 释义 | 不當受孕 A claim by parent(s) for negligent non-prevention of pregnancy: McFarlane & Anor v Tayside Health Board [2000] 2 AC 59, [1999] 4 All ER 961, 3 WLR 1301 (HL). The doctor or health authority owes the parents a duty of care in the provision of services relating to the taking of decisions by them in connection with abortion and childbirth: Anderson v Forth Valley Health Board (1997) 44 BMLR 108, 1998 SLT 588. Compensatory damages may be recovered by the parents of the unplanned child: Emeh v Kensington and Chelsea and Westminster Area Health Authority [1984] 3 All ER 1044, [1985] QB 1012 (CA). These damages may include all prenatal and postnatal medical expenses, the mother’s pain and suffering during pregnancy and delivery, and loss of consortium. Additionally the parents may recover the reasonable costs of rearing the unplanned child subject to offsetting the value of the child’s aid, comfort and society during the parents’ life expectancy: Emeh v Kensington and Chelsea and Westminster Area Health Authority, supra. A healthy parent who has given birth, in a wrongful conception case, to a severely disabled child may recover the costs of rearing him attributable to the disability: Parkinson v St James and Seacroft University Hospital NHS Trust [2002] QB 266.
