释义 | 服從責任 The duty of an employee to carry out lawful orders given by an employer: Halsbury’s Laws of Hong Kong, Vol 10(2), Employment Law [145.036]. Whether an order is lawful is determined by the scope of the contract of employment. Where the employee wilfully disobeys a lawful and reasonable order, the employer is entitled to summarily dismiss the employee without notice or payment in lieu: Employment Ordinance (Cap 57) s 9(1)(a)(i). The duty of obedience is subject to the employer’s obligation not to give an employee orders that are illegal or dangerous. The danger complained of must be immediate and personal: Bouzourou v Ottoman Bank [1930] AC 271. Where the employer dismisses the employee by reason of the employee’s refusal to obey dangerous or illegal orders, the employee may claim to have been constructively dismissed.
