释义 | 共同義務 An obligation or liability assumed by two or more persons jointly. Action to enforce a joint obligation must be taken by or against all parties together. Part payment by one joint debtor normally binds all persons liable in respect of the debt: while an acknowledgment only binds the person making the acknowledgment and his successors: Limitation Ordinance (Cap 347) s 25(5), (6). There is no equitable principle that a joint obligation at law should be treated as joint and several in equity: Kendall v Hamilton (1879) 4 AC 504 (HL).
