释义 | 精神欠妥 A mental condition which may arise from disease or age which makes a person incapable of managing his or her own affairs: HKSAR v Leung Wai Chung [1999] 2 HKC 471 (CA). A common instance is senile dementia caused by age (arteriosclerotic degeneration) or in the case of a person who suffers a stroke, the mental infirmity is caused by disease. A person suffering from mental infirmity such as senile dementia does not make that person a ‘mentally ill’ person. Mental infirmity of the defendant may be taken into account as going to the gravity of provocation as applied to the defendant: Luc Thiet Thuan v The Queen [1996] 1 HKC 663 (PC).
