释义 | 間接歧視 Discrimination on the basis of a person’s attribute (such as the person’s race or sex) by imposing, or proposing to impose, a term with which the person does not or is unable to comply, and with which a higher proportion of people without the attribute comply or are able to comply, and the term is not reasonable in all the circumstances of the case: Sex Discrimination Ordinance (Cap 480) ss 5(1)(b), 6, 7(1)(b), 8(b); Disability Discrimination Ordinance (Cap 487) s 6(b); Tsang Helen v Cathay Pacific Airways Ltd (No 2) [2001] 4 HKC 585 (CA). Relevant circumstances include the consequences of failure to comply with the term, the cost of alternative terms, and the financial circumstances of the person who imposes, or proposes to impose, the term.
