The doctrine that there is but one Crown throughout the Empire, its powers being exercised by agents in each particular dominion: Williams v Howarth [1905] AC 551 (PC). The doctrine has been accepted elsewhere in the British Commonwealth. Legislation expressed to bind the Crown is presumed, however, only to bind the Crown in right of the legislating territory: Bradken Consolidated Ltd v Broken Hill Proprietary Co Ltd (1979) 145 CLR 107. The continued validity of this doctrine is under challenge: R v Secretary of State for Foreign and Commonwealth Affairs ex p Indian Assn of Alberta [1982] 2 All ER 118, QB 892 (CA). See also Crown.
