| 释义 | 多年的租賃 A lease in possession or of the reversion, which may but need not require the payment of rent, and which may but need not include provision for impeachment for waste. A tenancy for a term of years arises by express contract (Land Settlement Assn Ltd v Carr [1944] 1 KB 657 (CA)). It is essential to the contract that the commencement and duration of the term should be so defined as either to be certain in the first instance, or to be capable of being afterwards ascertained with certainty: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.184]. Its duration is either for a fixed period of any duration or else can be determined on a fixed period of notice. A term of years need not be for a continuous period: Cottage Holiday Associates Ltd v Customs and Excise Cmrs [1983] QB 735, 2 WLR 861.
