| 释义 | 治外法權 The operation of legislation upon persons or things outside the territory of the legislating region. Legislation is presumed not to operate extra-territorially: Forsyth v Forsyth [1948] P 125 (CA). But there is nothing express or implicit under the Basic Law of the Hong Kong SAR that appears to restrict the competence of the legislature of the Hong Kong SAR to legislate extra-territorially, provided that the laws so enacted would be subject to supervision of the Standing Committee of the National People’s Congress under the Basic Law of the Hong Kong SAR art 17, in terms of conformity with provisions of the Basic Law of the Hong Kong SAR regarding affairs within the responsibility of the Central Authorities or regarding the relationship between the Central Authorities and the Hong Kong SAR. 對立法地區以外的人或事所實施的法例。法例被推定不可在司法權以外的領土施行：Forsyth v Forsyth [1948] P 125 （上訴法院）。但《香港特別行政區基本法》看來沒有明示或默示限制香港特區立法機構的治外法權能力，但以所制定的法律須符合根據《香港特別行政區基本法》第17條全國人民代表大會常務委員會的監管為限，並符合《香港特別行政區基本法》關於中央管理的事務及中央和香港特別行政區的關係的條款。n. |
