A treaty between states requiring a state party to surrender to another state party an individual accused or convicted of an offence committed within the jurisdiction of the requesting state (which is competent to try to punish the individual and to demand the surrender). A state may refuse to extradite an individual facing political persecution. International law does not recognise a general liability of states to extradite in the absence of an extradition treaty. The Hong Kong SAR government has been authorised by the Central People’s government of the PRC, which is responsible for the foreign affairs relating to the Hong Kong SAR, to conclude some agreements with government of a foreign country for the surrender of fugitive offenders, for example, the Agreement between the United States of America and the Hong Kong SAR for the Surrender of Fugitive Offenders, signed on 20 December 1996 and came into force on 21 January 1998 set out in the Fugitive Offenders (United States of America) Order (Cap 503F) sch 1. 國家之間簽立的條約,規定某締約國將某獨立被告或被定罪的人移交另一締約國,而該人在作出要求的國家的管轄範圍內(有權嘗試懲罰該人及要求移交)犯罪。某國可拒絕引渡任何受政治迫害的獨立人士。在沒有引渡條約的情況下,國際法律不會承認國家之間有關引渡的一般法律責任。香港特別行政區政府獲負責有關香港特區外交事務的中華人民共和國中央政府授權,就移交逃犯與外國政府締結協定,例如於1996年12月20日簽訂,並於1998年1月21日生效的香港特區政府和美利堅合眾國政府關於移交逃犯的協定,在《逃犯(美利堅合眾國)令》(第503F章)附表1列出。另見 Extradition。
