| 释义 | 引渡條約 A treaty between states requiring a state party to surrender to another state party an individual accused or convicted of an offence committed within the jurisdiction of the requesting state (which is competent to try to punish the individual and to demand the surrender). A state may refuse to extradite an individual facing political persecution. International law does not recognise a general liability of states to extradite in the absence of an extradition treaty. The Hong Kong SAR government has been authorised by the Central People’s government of the PRC, which is responsible for the foreign affairs relating to the Hong Kong SAR, to conclude some agreements with government of a foreign country for the surrender of fugitive offenders, for example, the Agreement between the United States of America and the Hong Kong SAR for the Surrender of Fugitive Offenders, signed on 20 December 1996 and came into force on 21 January 1998 set out in the Fugitive Offenders (United States of America) Order (Cap 503F) sch 1.
