释义 | 公訴提控 The process in a criminal trial in which the indictment is read to an accused who is asked how he or she pleads to the count or counts contained in the indictment. See Criminal Procedure Ordinance (Cap 221) s 49; District Court Ordinance (Cap 336) Sch 2 Pt II(1); Magistrates Ordinance (Cap 227) s 19. An accused is arraigned prior to a jury being selected: R v Tonner (1985) 80 Cr App R 170 (CA). Each count in an indictment should be put separately to the accused and he or she should plead separately to each: R v Boyle [1954] 2 All ER 721, 38 Cr App Rep 111, 2 QB 292 (CCA). An accused may enter a plea of guilty, not guilty, autrefois convict, or autrefois acquit: Criminal Procedure Ordinance (Cap 221) ss 31, 51(1). Alternatively, the accused may plead that the court does not have jurisdiction to try him or her: R v Jameson [1896] 2 QB 425 (DC).
