A contract that involves several distinct performances. The performances of a divisible contract, which is also known as severable contract, are independent from each other. The performances of different contracts may be treated as indivisible thus a single contract: Chevalier (HK) Ltd v Chinluck Ltd (HCA 12692/97, unreported). Under a divisible contract, a party is allowed to demand performances of the other without performing his own as the promises of each party to the contract are independent of each other. A normal presumption is in favour of entire contract, as to whether the contract is divisible depends on the parties’ intention as well as the inference drawn from the circumstances. Divisible contracts are distinguishable from ‘entire’ or ‘indivisible contracts’. See also Bankrupt; Divisible property.
