释义 | 主觀測試 In criminal law, the test of what a particular person would contemplate as the probable result of his act or default. For example, the test of dishonesty is a two stage test: (1) what was done must be regarded as dishonest by reasonable and honest people (the objective test), and (2) the offender must have realised that what was done was dishonest by such standards (the subjective test): R v Ghosh [1982] QB 1053, 2 All ER 689 (CA); HKSAR v Goh Swee Yan Angelina [2000] 3 HKLRD 324, 2 HKC 711 (CA). A subjective test is adopted when determining the reasonableness of any needs claimed or expenses incurred by the plaintiff. The plaintiff’s personal circumstances, race, personality and belief should be taken into account: Mui Ling Kwan v Wong Ying Wah [1973] HKLR 465.
