释义 | 身分不詳的人 In criminal law, a person whose name is unidentified. It may be impracticable to give such a description or designation for any other reason: Indictment Rules (Cap 221C) r 6(2); Au Tak Wing v R [1980] HKLR 409 (CA). In an indictment charging a conspiracy, failure to identify other conspirators or victims of a conspiracy by name, designation or description does not invalidate the charge: Indictment Rules (Cap 221C) r 4; Chim Pui Chung v HKSAR [1999] 1 HKLRD 836 (CFA). However, it may not provide a sufficient base of particulars in an attempted theft case to aver that the accused attempted to steal on a particular date from an ‘unknown female’ without more, at least the location of the offence was necessary: R v Yeung Kwok Chuen (CACC 857/83, unreported).
