| 释义 | 不適宜受審的人士 A person who has committed a criminal offence but, due to disability or mental illness, is unfit to stand trial because he or she does not understand the nature of the charge, the nature of the court proceedings, is unable to exercise the right of challenge, is unable to follow the evidence against him or her (R v Berry (1977) 66 Cr App Rep 156 (CA)), or is unable to offer his or her version of the facts to his or her counsel and the court (R v Sharp [1957] 1 QB 552, 1 All ER 577 (CCA)): R v Bradley (No 2) (1986) 85 FLR 111. It is not limited to a specific form of disability: R v Burles [1970] 2 QB 191, 1 All ER 642, 54 Cr App Rep 196 (CA). The fact that the accused is suffering from some form of hysterical amnesia or senile dementia does not, of itself, render the accused unfit to be tried: R v Podola [1959] 3 All ER 418, 43 Cr App Rep 220, [1960] 1 QB 325 (CCA); R v Chiu Te Ken Deacon & Anor [1993] 3 HKPLR 483, 2 HKLR 21. Where it is determined that the accused person is under disability, the trial may not proceed or further proceed because such a determination is a bar to the accused being tried or further tried: Criminal Procedure Ordinance (Cap 221) s 75A(1).
