| 释义 | 破壞社會安寧 Conduct that threatens to create civil unrest or disturbance. It involves ‘an act of violence or threat of violence’ whereby ‘harm is actually done or likely to be done to a person or in his presence, to his property, or a person is in fear of being harmed through an assault, an affray, a riot, unlawful assembly or other disturbance’: R v Howell [1981] 3 All ER 383, 3 WLR 501 (CA); R v Kam Man Fai [1983] 1 HKC 614 (HC); R v To Kwan Hang & Anor (1994) 2 HKC 293, 4 HKPLR 356 (CA). The court has the power to bind over any person to keep the peace if it is satisfied that the person has been guilty of violent conduct tending to breach the peace: R v Mok Dip Yan [1988] HKC 774 (HC). A person who witnesses a breach of the peace may intervene using reasonably necessary force to prevent the continuance or renewal of a breach of the peace: R v Duffy [1966] 1 All ER 62, 50 Cr App Rep 68 (CCA).
