释义 | 婚姻破裂 The end of a marriage. The breakdown of a marriage must be irretrievable if relied on as a ground of divorce or judicial separation: Matrimonial Causes Ordinance (Cap 179) ss 11, 24. Where relied on as a ground of divorce either in a petition for divorce or in a petition for judicial separation, the court will not hold a marriage to have broken down irretrievably unless one or more of the facts listed in s 11A(2) are proved. Where relied on as a ground for divorce in an application for divorce, the court must be satisfied that one or more of the facts listed in s 11B(2) are proved before it will find a marriage to have broken down irretrievably. See also Divorce; Separation. 婚姻關係終結。如欲倚據婚姻破裂作為離婚或裁判分居的理由,則有關的婚姻破裂必須是無可挽救的:《婚姻訴訟條例》(第179章)第11,第24條。凡在離婚呈請或裁決分居呈請中,倚據婚姻破裂作為離婚理由,則除非呈請人能證明第11A(2)條中所列明的一項或以上事實屬實,否則法院不會裁定婚姻已無可挽救地破裂。凡在離婚申請中,倚據婚姻破裂作為離婚理由,則法庭須信納,呈請人已證明第11B(2)條中所列明的一項或以上事實屬實,才能夠裁定婚姻已無可挽救地破裂。另見 Divorce; Separation。 |
