释义 | 違約 The failure of a party to a contract to perform a contractual obligation; or an anticipatory breach. A failure to perform occurs if a promisor, without lawful excuse, fails to discharge a contractual obligation at the time stipulated for performance. An anticipatory breach of contract arises prior to the time for performance by the promisor. The commission of a breach of contract by the promisor provides the promisee with remedies, which may include damages and rescission of the contract.
