释义 | 違反禁制令 Non-compliance with the terms of an injunction as specified in the court order. It is punishable as a civil contempt of court: Jennison v Baker [1972] 1 All ER 997, 2 QB 52 (CA). It may be committed in the absence of wilful disobedience on the part of the contemnor: Knight & Anor v Clifton & Ors [1971] 2 All ER 378, Ch 700 (CA). The court has power to order committal or sequestrations in any case where contempt is found, for example, repeated breaches of a Mareva injunction: Z Bank v D1 & Ors [1994] 1 Lloyd’s Rep 656. However, casual or accidental breaches are dealt with more leniently than intentional or reckless disobedience: Heatons Transport (St Helens) Ltd v Transport and General Workers’ Union [1973] AC 15 (HL). The court will only punish the contemnor where it is satisfied that the terms of the injunction are clear and unambiguous and the contemnor has proper notice of the terms: R v City of London Magistrates’ Court & Anor, ex p Green; Green v Staples & Ors [1997] 3 All ER 551, [1998] Crim LR 54. The breach of the injunction has to be proved beyond reasonable doubt: Re Bramblevale Ltd [1969] 3 All ER 1062, [1970] Ch 128 (CA).
