Judicial |
A description of that which emanates from a judge (judge of District Court or above, or the presiding officer of the Lands Tribunal) or judicial officer (registrar, master or magistrate) when exercising the power to determine liability, prescribe penalty, or otherwise affect the legal rights of subjects through the application of law to particular facts and circumstances. Not all things done by a judicial officer are judicial, some are regarded as merely administrative: for example, Hong Kong High Court Practice Directions 5.1(13). The assessment of damages in libel cases is more of social than a judicial function and there is no reason to suppose that a judicial view is more likely to be correct than the collective view of a jury that consists of sensible people acting reasonably: Cheung Ng Sheong Steven v Eastweek Publisher Ltd & Anor [1995] 3 HKC 601 (CA). adj. |
