释义 | 刑事毀壞 Unlawful damage or destruction of any property belonging to another. Criminal damage is an offence: Crimes Ordinance (Cap 200) s 60(1). The mens rea of this offence is the intention to destroy or damage the other person’s property or being reckless as to whether any such property would be destroyed or damaged. ‘Damage’ is given a broad interpretation by the courts to mean ‘any alteration to the physical nature of the property concerned’: R v Whiteley [1991] 93 Cr App R 25 (CA). Computer programmes or data are deemed as property protected by law from criminal damage: s 59(1)(b). It is an aggravated offence to destroy or damage property with the intent to endanger another person’s life or to be reckless as to whether another person’s life is endangered: s 60(2).
