1.The party who issues a bankruptcy petition. A bankruptcy petition may be issued by: creditors whether individually or jointly; the debtor himself; or the nominee or any other person who is bound by the debtor’s voluntary arrangement as approved by the creditors; or the Official Receiver where a criminal bankruptcy order has been made against the debtor: Bankruptcy Ordinance (Cap 6) s 3(1). The previous requirement imposed on a petitioning creditor to prove commission by the debtor of an act of bankruptcy is now abolished. A creditor is only required to prove that the debtor is unable to pay his debts or has no reasonable prospect of being able to pay: s 6(2)(c). 2. In family law, the person who was seeking from the court a decree for dissolution or nullity of marriage, restitution of conjugal rights, judicial separation, jactitation of marriage or for ancillary relief.
