释义 | 阻止判決 In criminal proceedings, a motion made to the trial judge after conviction but before sentence to quash the conviction on the basis that there is an error of law on the face of the indictment which has not been cured by amendment or by the verdict of the jury: France (or Frame) v White (1840) 1 Man & G 730; Criminal Procedure Ordinance (Cap 221) s 53. The defect can be as to the form of the charge or the particulars relied upon. The purpose of giving an allocutus is to ask whether the convicted person wishes to raise such an objection before the court moves to sentence. If the motion succeeds the accused can be reindicted on the same facts: Vaux’s case (1591) 4 Co Rep 44a.
