| 释义 | 教育機構 1. A primary or secondary school, higher education institution, or institute of technical and further education. It may be established and maintained by government department or non-government body. Discrimination in educational establishments against a person by reason of sex, disabilities or family status is unlawful: Sex Discrimination Ordinance (Cap 480) s 39; Disability Discrimination Ordinance (Cap 487) ss 24, 37; Family Status Discrimination Ordinance (Cap 527) s 18. 2. In relation to copyright, it includes any school, within the meaning of the Education Ordinance (Cap 279) s 3, entirely maintained and controlled by the Government. There are certain exceptions to the copyright infringement in the statute. The performance of a literary, dramatic or musical work, before an audience consisting of teachers and pupils at an educational establishment and other persons directly connected with the activities of the establishment by a teacher or pupil in the course of the activities of the establishment, or at the establishment by any person for the purposes of instruction, is not a public performance for the purposes of infringement of copyright: Copyright Ordinance (Cap 528) s 43. The playing or showing of a sound recording, film, broadcast or cable programme before such an audience is not a playing or showing of the work in public for the purposes of infringement of copyright: s 43. A recording of a broadcast or cable programme, or a copy of such a recording may be made by or on behalf of an educational establishment for the educational purposes of that establishment without thereby infringing the copyright in the broadcast or cable programme, or in any work included in it, if an acknowledgement of authorship or other creative effort contained in the work recorded is incorporated in the recording made by the establishment; and it is not made for gain: s 44(1). Reprographic copies of artistic works or of passages from published literary, dramatic or musical works may, to a reasonable extent, be made by or on behalf of an educational establishment for the purposes of instruction without infringing any copyright in the work, or in the typographical arrangement: s 45(1).
