释义 | 分割 The vertical division of the lot into smaller units in a housing estate, or the horizontal division of a multi-storey building into separate units. In relation to a high-rise block of flats, each flat owner will become a tenant in common of the whole plot holding a number of undivided shares in the lot, together with the exclusive right to occupy a specified flat: for example, Jumbo King Ltd v Faithful Properties Ltd & Ors [1999] 4 HKC 707, 3 HKLRD 757. When subdividing the land, the owner must comply with the provisions of Town Planning Ordinance (Cap 131) and Buildings Ordinance (Cap 123). Orders can be made leading to the physical partitioning, ie subdivision of land: Partition Ordinance (Cap 352) s 4.
