释义 | 群島水域 Maritime waters within archipelagic baselines except for waters enclosed by closing lines drawn across river mouths, bays, and ports, which are internal waters: United Nations Convention on the Law of the Sea 1982 arts 47, 50. An archipelagic state has sovereignty over its archipelagic waters but must respect existing rights of third states such as fishing rights, navigational rights on the basis of innocent passage, the right to lay and maintain cables, and rights derived from agreements: arts 47, 49, 51-53. The significance of recognising archipelagic waters as a sui generis category of sea - a tertium quid which is neither territorial sea nor internal water - is that it affords the possibility of some compromise between the sovereignty of the states over these waters, and the requirement of international navigation: Oppenheim’s International Law (9th Ed) p 648.
