In family law, a petition for divorce is deemed to be duly served if an acknowledgement of service in the prescribed form is signed by the party to be served or by a solicitor on his behalf and is returned to the registry: Matrimonial Causes Rules (179A) r 14(5)(a). 2. A formal admission by or on behalf of a party that the party has been served with a writ or an originating summons. It must be in a prescribed form: The Rules of the High Court (Cap 4A) O 12 r 3. However, the acknowledgment of service by a defendant of service of a writ shall not be treated as waiver by him of any irregularity in the writ or service thereof or in any order giving leave to serve the writ out of jurisdiction or extending the validity of the writ for the purpose of service: O 12 r 7.
