释义 | 事實 Any act, occurrence, or other thing deemed legally relevant to an issue at trial. Facts are required to make out the elements of an offence or claim in a case and are established by parties adducing evidence tending to show the tribunal of fact that the fact exists. Generally, the jury decides question of fact where there is a jury, while the judge decides question of law. Where the judge is sitting alone, he or she will be responsible for deciding all issues. An appeal court may set aside a verdict if it comes to the conclusion that the jury’s determination of the facts was unsafe and unsatisfactory.
