| 释义 | 口頭租契 A lease created by an oral agreement: Yuenfield Ltd v Cuming Development Co Ltd [1998] 1 HKLRD G37. An oral lease is effectively created at law provided that the term does not exceed three years, whether or not the lessee is given power to extend the term, at the best rent which can be reasonably obtained without taking a premium: Conveyancing and Property Ordinance (Cap 219) s 6(2). An oral lease may be made by any words showing the intent to give exclusive possession for the term: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.070]. In practice, oral leases are rarely assigned. The practical difficulty is that there is no written record of the terms of the lease.
