Mere acquiescence of a continuing adulterous affair is sufficient to amount to connivance: Rumbelow v Rumbelow & Hadden [1965] P 207. Where an applicant spouse applies for any order under the Separation and Maintenance Orders Ordinance (Cap 16) s 5 if the other spouse can prove adultery against the applicant spouse, the court will not make any such orders: Separation and Maintenance Orders Ordinance (Cap 16) s 6(1).
