In criminal law, the commencement or conduct of a criminal prosecution that results in injustice or offends against a sense of what is fair in all the circumstances of the matter. Under common law, the court has power to grant a stay of the criminal proceedings on the ground of oppression: R v Soo Fat Ho [1992] 2 HKCLR 114 (CA). The correct test to be applied by the court is whether an independent observer sitting at the back of the court, knowing all the facts, would regard the continuance of the trial unfair and oppressive. If the answer is negative, then the trial should proceed. If the answer is affirmative, it will be a sufficiently exceptional case to warrant a stay being granted. In other words, the court must consider all the relevant facts, conduct a balancing act in the round, and place itself as best in the position of that independent observer: R v Flickinger (1993) 3 HKPLR 677.
