释义 | 指示提單 A bill of exchange which is expressed to be payable to order (for example, ‘pay Smith or order’), or expressed to be payable to a particular person, and does not contain words prohibiting transfer or indicating an intention that it should not be transferable (for example, ‘pay Smith’): Bills of Exchange Ordinance (Cap 19) s 8(4). Where a bill, either originally or by indorsement, is expressed to be payable to the order of a specified person (for example, ‘pay to the order of Smith’), and not to him or his order (for example, ‘pay to Smith or order’) it is nevertheless payable to him or his order at his option: s 8(5). See also Bearer bill; Bill of exchange; Indorsement. 匯票如明示須付款予指定人(例如「支付陳大文或指定人」),或明示須付款予某人,而並無載有文字禁止將該匯票移轉,亦無載有文字顯示該匯票應不可移轉的意向(例如「支付陳大文」),則該匯票可用以付款予指定人:《匯票條例》(第19章)第8(4)條。匯票如原先明示或以背書明示,須付款予某指明的人所指定的人,而非明示可付款予該人或其指定的人,則該匯票仍可用以付款予該人或其指定的人,按該人的選擇而定:第8(5)條。另見 Bearer bill; Bill of exchange; Indorsement。 |
