释义	續約選擇權 An option to take a lease for a further time conferred on the lessee: Moss v Barton (1866) LR 1 Eq 474; Austin v Newham [1906] 2 KB 167. A covenant, commonly found in leases, granting to the lessee the right (option) to enter into a new lease for a special term on expiry of the current lease. Such an option constitutes an offer which the landlord is contractually precluded from withdrawing so long as the option remains exercisable: Beesly v Hallwood Estates Ltd [1960] 2 All ER 314, 1 WLR 549. It may be possible to exercise the option by conduct: Gardner v Blaxill [1960] 2 All ER 457, 1 WLR 752. All lands are held in leasehold in Hong Kong, the maximum duration of the perpetually renewable lease is limited to that of the reversion, thus an option to renew must be exercised strictly in accordance with the stipulated conditions: Shields, Donald W v Mary Chan (No 2) [1972] HKLR 121 (CA). An option to renew runs with the land and with the reversion, and so both the landlord’s and the tenant’s successors in title are bound: Woodall v Clifton [1905] 2 Ch 257 (CA); Weg Motors Ltd v Hales [1962] Ch 49, [1961] 3 All ER 181 (CA). An option to renew is registrable if it is created by an instrument in writing: Markfaith Investments Ltd v Chiap Hua Flashlights Ltd [1990] 2 HKLR 84, [1991] 2 AC 43 (PC); Chan Yiu Tong v Wellmake Investments Ltd [1996] 2 HKLR 44, 1 HKC 528 (CA).
