释义	追索估量 The basis of calculating the amount of a defendant’s liability. The measure of recovery depends on the nature of the liability, for example, the fulfilment of contractual or detrimentally relied-upon expectations, compensation for loss, or restitution of unjust enrichment. Restitutionary recovery can be measured in two ways: by the benefit provided by the plaintiff or the profit earned by the defendant, and by the value received by the defendant or the value surviving.
